1. Before you submit a notice
A DMCA notice is a formal legal request. Submit one only if you own the copyright or are authorized to act for the owner. First confirm that the material appears on a GetBoat page and consider whether the use may be licensed, otherwise authorized or permitted by law, including fair use.
Knowingly making a material misrepresentation that material is infringing, or that it was removed by mistake, may create liability under 17 U.S.C. § 512(f). If you are unsure, consider obtaining legal advice before filing.
2. Copyright takedown notice
To help us identify and process a request, send a written notice that substantially includes every item below:
- Signature. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Copyrighted work. Identification of the copyrighted work claimed to have been infringed. If one notice covers multiple works at one online location, provide a representative list.
- Material and location. Identification of the material claimed to be infringing, or the subject of infringing activity, that should be removed or disabled, plus information reasonably sufficient for us to locate it. Include each exact GetBoat URL.
- Contact information. Information reasonably sufficient for us to contact you, such as your full name, mailing address, telephone number and, if available, an email address.
- Good-faith statement. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
- Accuracy and authority statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.
Send the notice in English. A notice in another language should include an English translation. Combining all affected URLs, supporting context and proof of authority in one clear submission helps avoid delay.
3. Where to send a notice
Email is the fastest route. Use a clear subject line such as “DMCA Copyright Notice” and send the complete notice to:

4. What happens after a notice
- Review. We assess whether the notice substantially complies with § 512 and may request missing information.
- Action. When appropriate, we act expeditiously to remove or disable access to the identified material.
- Notification. We make reasonable efforts to notify the user who supplied the affected material and may provide that user with a copy of the notice, including the claimant’s contact information.
- Record and follow-up. We may ask either party for clarification, preserve relevant records and process any compliant counter-notification.
If a notice identifies the copyrighted work, identifies the material and its location, and provides contact information but is otherwise incomplete, we will promptly attempt to contact the sender or take other reasonable steps to help obtain a notice that substantially meets all six requirements.
Removing material is not a determination that infringement occurred. GetBoat does not adjudicate ownership disputes; the parties or a court ultimately resolve them.
5. Counter-notification
If your material was removed or disabled and you believe that happened because of mistake or misidentification, you may send a written counter-notification containing every item below:
- Signature. Your physical or electronic signature.
- Removed material. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- Mistake statement. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
- Contact information. Your full name, mailing address and telephone number. Please also provide an email address if available.
- Jurisdiction and service. A statement consenting to the jurisdiction of the U.S. Federal District Court for the judicial district where your address is located—or, if your address is outside the United States, any judicial district where GetBoat may be found—and accepting service of process from the person who submitted the original notice or that person’s agent.
Send the counter-notification to the copyright contact above, preferably by email with the subject “DMCA Counter-Notification”.
After receiving a substantially compliant counter-notification, we will promptly send a copy, including the subscriber’s contact information, to the person who submitted the original notice and inform that person that we intend to restore the material after 10 business days, subject to the process below.
Restoring material
We will restore or stop disabling access to the material not less than 10 and not more than 14 business days following our receipt of a substantially compliant counter-notification, unless our copyright contact first receives notice from the original claimant that they have filed an action seeking a court order to restrain the allegedly infringing activity.
6. Repeat infringer policy
In appropriate circumstances, GetBoat will terminate the accounts of users whom we determine to be repeat infringers. We may suspend access while we evaluate a matter and may consider valid notices, counter-notifications, retractions, court orders and the surrounding facts. We do not use an automatic public strike count, and we may act sooner where the circumstances warrant.
We may also reject abusive, fraudulent, duplicative or materially incomplete submissions and take appropriate action against misuse of this process.
GetBoat accommodates and does not interfere with standard technical measures, as defined by § 512(i), that copyright owners use to identify or protect copyrighted works.
7. Other claims, records and policy changes
Copyright submissions may be retained and disclosed when reasonably necessary to administer this process, enforce our terms, comply with law or protect rights. Do not include sensitive personal information that is not required for a valid submission.
This policy does not limit any rights, remedies or defenses available to GetBoat or any other person. We may update it to reflect legal, operational or service changes; the date at the top identifies the current version.
